AFFORDABLE HOUSING UPDATE December 20, 2025 From Mayor Gerald A. Buccafusco
Below is a summary of recent developments regarding the Borough’s Fourth Round Housing Element and Fair Share Plan (HEFSP):
The Borough participated in sessions with the Program Judge on December 10, December 18, and December 19, 2025.
The Borough reached a settlement agreement with Fair Share Housing Center (FSHC), resolving FSHC’s challenge to the Borough’s Fourth Round HEFSP.
The settlement does not include the proposed project at the La Dolce Vita site.
FSHC is recommending that Special Adjudicator Frank Banisch and Program Judge Bookbinder find the Borough’s HEFSP to be compliant with the Fair Housing Act.
The Special Adjudicator will prepare a report for submission to Judge Bookbinder regarding compliance.
Judge Bookbinder will issue a decision, which will then be referred to Judge Grasso-Jones, the Mount Laurel Judge, for further review.
Judge Grasso-Jones will determine whether to accept or reject the Program Judge’s decision.
Developer 101 4th Avenue, LLC has indicated that it will continue to challenge the Borough’s HEFSP.
This matter is expected to be before the Court in January for final adjudication.
